Who leads the Tribunal?

Since the evening of 30 October 2026, two groups claim to direct Poland's Constitutional Tribunal (TK). Some participants call the events a “zamach stanu” (coup d'état); others call them “restoring the rule of law”. This page uses neither label. It lists what official sources show, who says what, and what is still unverified.

Every line carries a tag: verified by a primary source, a named party's position, reported by media only, or unverified on X. English translations are unofficial; Polish is quoted from the official text.

Deputy PM and Minister of National Defence Władysław Kosiniak-KamyszThe PSL leader, whose party is in the governing coalition, wrote that trust in the TK is “ruined” and proposed what he calls a “constitutional reset” to end the dispute. He did not give details of the proposal in the post. Position
W obecnej sytuacji jest to jedyna szansa na stopniowe przywracanie normalności wokół TK.”Democracy and the rule of law are not ordinary slogans, but a commitment to guarantee the independence of the judiciary and to protect citizens' constitutional rights. In the current situation, when trust in the Constitutional Tribunal is ruined, citizens have no institution to guard their rights. That is why, consistently and for years, I have proposed a constitutional reset that will rebuild trust in the TK, guarantee judges' independence, end the undermining of the Tribunal's rulings and end the ongoing dispute. In the current situation it is the only chance of gradually restoring normality around the TK.

Prosecutor General Waldemar Żurek (via National Prosecutor's Office, @PK_GOV_PL)The National Prosecutor's Office said the Prosecutor General sent the Tribunal six motions on 30 October and 3 November for consent to hold TK judge Bogdan Święczkowski criminally liable, and one such motion concerning TK judge Bartłomiej Sochański. According to the communiqué, the Święczkowski motions come from four proceedings. The first concerns obstructing five judges elected by the Sejm from performing their duties between 9 April and 28 October 2026, including alleged force used against judge Maciej Berek on 14 October. The second concerns the use of operational-surveillance material and classified information while he was National Prosecutor; one of these motions is a resubmission after the TK General Assembly refused consent on 15 October 2025, a resolution the prosecutor considers to have no legal effect. The third concerns the National Prosecutor's Office's purchase of the “Hermes” system, and the fourth the delegation of nine prosecutors. The Sochański motion concerns alleged obstruction of the same judges. These are the prosecutor's allegations. The communiqué cites Art. 196 of the Constitution and Art. 20 and 23 of the 2016 Act on the status of TK judges, under which consent is given by a resolution of the TK General Assembly, which should be adopted within a month. Head of the Chancellery of the President Zbigniew Bogucki (via @prezydentpl)The President's account posted written excerpts from an interview Zbigniew Bogucki gave to TV Republika. Referring to the Prime Minister's words “It's heading in a good direction”, he said things would head in a good direction when the police leave the Tribunal and, in his words, lawful judges arrive in their place. He said the 3 November General Assembly did not take place because there was no quorum, and described it as another stage of gathering information and evidence against those taking part, in the words quoted below. The full interview has not been transcribed here. Position
The General Assembly did not take place because there was no quorum. It is, however, another stage of gathering information and evidence that these people are carrying out a coup d'état, brutally breaking the Constitution and the statutes. (…) Whoever takes part in this accepts lawlessness. Donald Tusk is today the man who brought usurpers into the Constitutional Tribunal and stands at the head of this ostentatious lawlessness.

Secretary of State in the Chancellery of the President Wojciech Kolarski (via @prezydentpl)The President's account posted a written excerpt from comments Wojciech Kolarski made to Wirtualna Polska. He said the world, including the United States, had seen images of violence from Warsaw. He described an ambassador's post as an expression of concern that the Polish authorities were dealing with events at the Tribunal, in the words quoted below, instead of preparing for the G20 summit and finalising a decision on a permanent US base. The post does not name the ambassador or link the ambassador's post, and its content has not been established here. Position
Wpis ambasadora jest wyrazem zaniepokojenia, że polskie władze, zamiast przygotowywać się do szczytu G20 i finalizować decyzję o stałej bazie, zajmują się przemocowym przejęciem Trybunału Konstytucyjnego.”The whole world saw the images and scenes of violence from Warsaw, which does not serve Poland, and America saw it. The ambassador's post is an expression of concern that the Polish authorities, instead of preparing for the G20 summit and finalising the decision on a permanent base, are busy with a violent takeover of the Constitutional Tribunal.

Head of the Chancellery of the President Zbigniew Bogucki (via @prezydentpl)The President's account posted a written statement signed by Zbigniew Bogucki, quoted below, after his briefing outside the Presidential Palace that afternoon. He said the Chancellery of the President will file notifications of possible crimes with law enforcement: one under art. 128 § 1 of the Criminal Code, which he described as using force to influence a constitutional organ of the Republic, and one under art. 135 of the Criminal Code, concerning active assault on the President, in connection with what he described as an attempt to prevent the President from entering the Tribunal's building. The post does not name any person, and whether the notifications have been filed is not established. The briefing video has not been transcribed here. Position
„Kancelaria Prezydenta RP złoży zawiadomienie o możliwości popełnienia przestępstw. Pierwsze dotyczy art. - Szef KPRP @BoguckiZbigniew”The Chancellery of the President of the Republic of Poland will file a notification of possible crimes. The first concerns art. 128 paragraph 1 of the Criminal Code, that is, the felony concerning an attack on a constitutional organ: influencing a constitutional organ of the Republic by force. Anyone who approaches this objectively has absolutely no doubt that this is the kind of situation we are dealing with. Unfortunately, for the first time in free Poland, under Prime Minister Donald Tusk's government, through people who decided to follow the path of brutal lawlessness, under police cover, under the cover of the Interior Ministry's services, this kind of criminal practice is being carried out. I say “criminal” [zbrodniczy, i.e. a felony] because this act carries a penalty of 3 years' imprisonment or more. That is why I use this statutory wording. In connection with the shameful situation that occurred during the attempt to prevent the President from entering the seat of the Constitutional Tribunal, a notification of a crime under art. 135, concerning active assault on the President of the Republic, will also be filed. - Head of the Chancellery of the President @BoguckiZbigniew

National Police HQ (@PolskaPolicja)National Police HQ said a notification of a suspected crime has been submitted to the National Prosecutor, concerning alleged insult of a public official and defamation through the mass media of Deputy Police Commander-in-Chief nadinsp. Tomasz Michułka. It says the notification concerns social media publications suggesting that he ordered riot police units to be equipped with machine guns for use against people at assemblies outside the Tribunal. It says the readiness and equipment of the designated units were in fact due to threats of sabotage and subversion on Poland's north-eastern border. The post does not say who submitted the notification or name the authors of the publications. Whether the prosecutor's office has taken any step is not established. Position
A notification of a crime to the detriment of Deputy Police Commander-in-Chief nadinsp. dr Tomasz Michułka has been submitted to the National Prosecutor, consisting of insulting a public official and defaming him by means of mass communication through the deliberate spreading of false information. The notification concerns social media publications suggesting that nadinsp. dr Tomasz Michułka issued an order to equip police riot units with machine guns in order to use them against citizens taking part in assemblies outside the Constitutional Tribunal. In reality, placing the designated forces on readiness and equipping them resulted from threats and the need to counter potential acts of sabotage and subversion on the north-eastern border of the Republic of Poland.

Deputy PM and Minister of National Defence Władysław Kosiniak-Kamysz (@KosiniakKamysz)The Deputy Prime Minister posted a detailed proposal he calls a “constitutional reset” for the Tribunal. He wrote that de-escalation around the TK is necessary and cited appeals by social organisations, the Entrepreneurs’ Council, the Supreme Bar Council, the Helsinki Foundation for Human Rights and the Polish Episcopate. He said the Constitution should be changed so that the National Assembly, by at least a 3/5 vote of its statutory members on a motion of the National Council of the Judiciary, ends the terms of all TK judges while confirming the validity of their election, with those judges retiring; new judges would then be chosen by the National Assembly under a new procedure he describes, with staggered terms and the oath taken before the National Assembly. An attached image was not transcribed here. Position
„Deeskalacja sytuacji wokół Trybunału Konstytucyjnego jest konieczna aby przywrócić obywatelom niezależny sąd konstytucyjny. Apelują o to przedstawiciele organizacji społecznych, Rada Przedsiębiorców, Naczelna Rada Adwokacka, Helsińska Fundacja Praw Człowieka i Episkopat Polski. Dlatego powinniśmy doprowadzić do zmian w Konstytucji. Tylko taki reset konstytucyjny daje szansę na odbudowę zaufania do Trybunału i zagwarantowanie spokoju społecznego.”De-escalation of the situation around the Constitutional Tribunal is necessary in order to restore to citizens an independent constitutional court. Representatives of social organisations, the Entrepreneurs’ Council, the Supreme Bar Council, the Helsinki Foundation for Human Rights and the Polish Episcopate are appealing for this. That is why we should bring about changes to the Constitution. The National Assembly, by a resolution of at least 3/5 of the votes of its statutory number of members, on a motion of the National Council of the Judiciary, should end the terms of all judges, while at the same time confirming the correctness of their election as judges of the Constitutional Tribunal. Those judges will retire. In subsequent steps, under the constitutional changes, new Tribunal judges should be chosen. New judges should be chosen by the National Assembly, on a motion of the Marshal of the Sejm naming candidates, after obtaining the opinions of the First President of the Supreme Court, the President of the Supreme Administrative Court and the nationwide bodies of the legal self-governments, with the prior consent of the President of the Republic. The election of judges by the National Assembly should be carried out by a majority of at least 3/5 of the votes of the statutory number of members of the Assembly. The Constitutional Tribunal would consist of 15 judges, whose terms — five judges each — would last 3, 6 and 9 years. The oath would be taken before the National Assembly. Only such a constitutional reset gives a chance of rebuilding trust in the Tribunal and guaranteeing social calm.
